Qualifying criteria to claim

  • The Spanish Supreme Court ruling has banned timeshare contracts that are in perpetuity or run for a period longer than 50 years 
  • Timeshare Law 42/1998 prohibits taking any form of payment including the reservation of payment during the cooling off period (this includes any payments made from a finance company on your behalf). 
  • You should have been informed of your right to cancel the timeshare contract within the cooling off period. 
  • Your timeshare contract should be in your own language and include details specific to your timeshare including:
       – Where the timeshare is located
       – Unit number
       – Rights of usage 
  • You should have been informed about the maintenance fees and the rate at which they could be expected to rise.
